3.4 This restriction applies regardless of whether additional people intend to stay overnight or are merely visiting during the day.

3.5 The Lead Guest must not advertise, offer or allow the Property to be used for accommodation by more people than the permitted maximum.

3.6 We may require reasonable evidence of the number of Guests staying at the Property where there is a genuine concern that the occupancy limit has been exceeded.

4. Visitors

4.1 Day visitors are permitted provided that the total number of people at the Property, including overnight Guests and visitors, does not exceed 14 people.

11.1 Smoking and vaping are not permitted inside the Property.

11.2 Guests must not use illegal drugs or controlled substances at the Property.

11.3 Any smoking or vaping must take place outside and must not create a nuisance, fire risk or damage.

15.2 Any deposit or advance payment required must be paid by the date stated in the booking confirmation.

15.3 Where a balance is payable, it must be paid by the stated due date.

15.4 We may treat failure to make a required payment by the due date as a cancellation by the Guest, subject to the cancellation terms applicable to the booking and applicable law.

16. Cancellation by the Guest

16.1 The cancellation terms applicable to the booking will be clearly stated before the booking is confirmed.

16.2 Where a booking is described as non-refundable, this means that the agreed cancellation charge may apply if the Guest cancels, subject always to the Guest's statutory rights and any circumstances in which applicable law requires a refund or other remedy.

16.3 Where cancellation charges apply, they should reflect the booking terms agreed at the time of booking and must not operate as an unfair or disproportionate penalty.

16.4 Guests should contact us as soon as possible if they need to cancel.

17. Changes to booking dates

17.1 Any request to change booking dates must be made in writing.

17.2 A change of dates is subject to availability and our written agreement.

17.3 Where a date change is agreed, we may reasonably adjust the price where the new dates have a different published or agreed rate.

17.4 A date change does not automatically create a right to a refund unless agreed or required by law.

18. Cancellation by Brownmore Investments Ltd

18.1 We will only cancel a confirmed booking where there is a legitimate reason to do so, including circumstances where:

  • the Property becomes unavailable;
  • the Property becomes unsafe or unsuitable for occupation;
  • necessary emergency works are required;
  • circumstances outside our reasonable control prevent the booking from proceeding; or
  • the Guest has seriously breached these Terms.

18.2 Where we cancel a booking for a reason not caused by the Guest, we will explain the position and provide any refund or other remedy required by the applicable contract and law.

18.3 Nothing in these Terms limits any legal rights the Guest may have where we fail to provide the accommodation in accordance with the contract.

19. Serious breaches

19.1 We may require Guests to leave the Property without refund where reasonably necessary because of a serious breach of these Terms, particularly where the breach:

  • involves an unauthorised party or event;
  • involves materially exceeding the permitted occupancy;
  • creates a serious safety risk;
  • causes serious damage;
  • involves unlawful activity;
  • causes serious nuisance or disturbance;
  • involves deliberate interference with fire or safety equipment; or
  • otherwise seriously affects the Property, neighbours or the safety of Guests.

19.2 Where reasonably practicable, we will contact the Lead Guest and give an opportunity to remedy a breach where the breach is capable of being remedied and immediate action is not reasonably necessary.

19.3 Any decision to terminate a stay will be exercised reasonably and proportionately.

20. Personal belongings

20.1 Guests are responsible for their own belongings.

20.2 We recommend that Guests do not leave valuable items unattended.

20.3 If an item is left behind, Guests should contact us promptly. Where possible, we will arrange its return, subject to reasonable postage, packaging or delivery costs.

21.2 Complaints should be sent to:

[email protected]

21.3 We will make reasonable efforts to respond promptly and resolve genuine problems.

21.4 Guests should not wait until after departure to report a problem where it could reasonably have been addressed during the stay.

22. Our responsibility to Guests

22.1 We will provide the accommodation in accordance with the booking and applicable law.

22.2 Nothing in these Terms excludes or limits liability where doing so would be unlawful.

22.3 In particular, nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

22.4 Subject to the above, we are not responsible for loss or damage to Guests' personal belongings where such loss or damage is not caused by our negligence or other breach of legal duty.

23. Unavoidable circumstances

23.1 We are not responsible for circumstances genuinely outside our reasonable control, where those circumstances prevent or materially affect the provision of the accommodation.

23.2 Such circumstances may include, depending on the circumstances, serious flooding, fire, major utility failure, structural problems, government restrictions, emergency works or other events beyond our reasonable control.

23.3 Where such circumstances occur, we will communicate with the Lead Guest as soon as reasonably practicable and explain the available options.

  • protecting the Property and its Guests.

24.3 Further information is contained in the Saltburn Townhouse Privacy Policy.

25. No transfer of booking

25.1 The Lead Guest must not transfer or resell the booking to another person without our prior written agreement.

25.2 The Property must not be used for commercial accommodation or re-letting.

26. Right of access

26.1 We will respect the Guest's occupation of the Property during the booking.

26.2 We or our authorised representatives may enter the Property where reasonably necessary, including:

  • in an emergency;
  • where there is a genuine concern about safety;
  • to carry out essential repairs;
  • where access is reasonably required to prevent serious damage; or
  • where we have reasonable grounds to believe that these Terms have been seriously breached.

26.3 Except in an emergency or where immediate access is reasonably necessary, we will endeavour to provide reasonable notice.

27. Entire agreement

27.1 These Terms, together with the booking confirmation and any specific written arrangements agreed between the parties, form the agreement relating to the booking.

27.2 If there is a conflict between these Terms and a specific written agreement subsequently made for the particular booking, the specific written agreement will apply to the extent of the conflict.

28. Changes to these Terms

28.1 We may update these Terms for future bookings.

28.2 The version applicable to a booking will be the version provided to or made available to the Lead Guest before the booking is confirmed.

28.3 We will not retrospectively change the contractual terms of an existing booking to the Guest's detriment without the Guest's agreement, except where a change is required by law.

29. Governing law and jurisdiction

29.1 This agreement is governed by the law of England and Wales.

29.2 Any dispute will be dealt with by the courts of England and Wales, subject to any mandatory rights the Guest may have under applicable consumer law.
